Florida Laws for Medical Marijuana Use

The passage of the November 2016 amendment to Florida’s previous medical marijuana laws requires the Florida Department of Health to establish new regulations regarding the licensing of medical marijuana doctors in Florida and dispensary operations.

 

Previously, doctors could only recommend low-THC marijuana to treat patients with debilitating health problems. Patients qualifying for full-strength medical marijuana in 2017 will need to obtain a state ID card showing they are a member of the Compassionate Use registry established by the Department of Health.

 

Language used in developing Amendment 2 permits licensed Florida medical marijuana doctors to recommend medical cannabis for any “debilitating medical condition.”

  •  Clients will be seen by Dr. Pichardo, a state approved Medical Marijuana Qualified Ordering Physician, registered with the FL Office of Medical Marijuana Use (OMMU).

  • The doctor will assess whether or not the use of low-THC and/or medical cannabis may be an effective treatment option, compared to conventional methods of medicine.

  •  

  • He will also discuss the potential, associated benefits and risks with the use of marijuana and the possibility of integrating it into their current medical regimen.

  •  

  • Any approved Clients will be assisted with obtaining a Registry Identification Card required to legally purchase and use the medicine from an authorized Medical Marijuana Treatment Center (MMTC).

How The Florida Marijuana Program Works

»Individuals suffering from the following medical conditions are eligible to receive medical cannabis within the state of Florida.

»To begin the process, a patient must have an in-person visit with a Florida physician who is certified in compassionate use. In order to provide certifications to patients, a doctor must have an active, unrestricted medical license and must complete a course issued by the Florida Medical Association.

»Once the physician has examined the patient, he or she can qualify (or “certify”) them to be able to purchase medical marijuana. After a patient is certified by a physician they must complete a medical marijuana ID card application with the Department of Health. When the Department approves the patient’s ID card application, the patient is legally then able to visit any of the state’s dispensaries or call a Medical Marijuana Treatment Center to arrange for delivery.

»The law requires patients to be re-certified each 210 days, and the physician can certify up to a 70-day supply of cannabis at a time at a maximum daily dose that is yet to be determined by the Department of Health.
